The reference to “us”, “we”, or “Pansy Boys” throughout this Privacy Policy refers to Pansy Boys Ltd (a company incorporated under the laws of Aotearoa/New Zealand).

The reference to “you”, or “your” throughout this Privacy Policy refers to users of our website, current previous or potential clients, suppliers, business partners, sub-contractors, and other business contacts.

This Privacy Policy replaces any previous Pansy Boys Privacy Policy as of the ‘Last Updated’ date above.

1.  Personal information, why we collect it and how we use it

Personal information is information we hold about you from which your identity is either apparent or can be reasonably determined. This may include but is not limited to your name, address, phone number, email address and IP address.

This information may come to us:

  • directly from you;

  • from someone who owns, manages or tenants your residence;

  • from someone who manages or works on your website, branding or other resources; or

  • from a person or business that refers you to us for products or services.

This information is collected only to the extent necessary to provide requested services.

We may collect personal information from you when:

  • you fill in one of our forms or surveys;

  • deal with us via voice call, messaging service, email or other digital platform; or

  • have contact with us in person.

Our website places browser cookies on your device to aid some functionalities of the site and to collect statistical information. Our website's Cookie Policy will give you more information on this.

We will retain your personal information for up to 7 years from our last engagement with you.

We will collect personal information from you by lawful and fair means and not in an unreasonably intrusive way. We will use your personal information only to provide our services to you or for a directly related purpose such as required or permitted by law or with your consent. To enable us to provide those services, we may disclose your personal information to relevant entities such as sub-contractors or a trusted marketing agent.

We do not share your personal information with other organisations outside the above unless you give us your consent, or where sharing is otherwise required or permitted by law, or where this is necessary on a temporary basis.

When we temporarily provide personal information to companies who perform services for us, such as specialist information technology companies or other contractors, we require those companies to protect your personal information as diligently as we do.

2. Your rights and choices

You have the right to request access to the personal information you provide, and to correct or update your personal information. This right is subject to certain exceptions allowed by law (see below at point number 4).

You may instruct us to remove any previous consent you provided to receive marketing communications from us.

Direct marketing and your privacy

From time to time we may use the personal information we collect from you to identify particular services which we believe may be of interest to you or send you promotional material by email, messaging service or phone to let you know about these services and how they may benefit you. We will always give you a choice to opt out of receiving such information in future. Opting out of receiving such communications will not prevent the sending of messages that specifically relate to your enquiries or order(s).

Surveys

From time to time we may use the personal information we collect from you to survey your opinion about our services. We will always give you a choice to opt out of participating in such surveys.  We reserve the right to reproduce or use any client survey responses or comments in relation to services provided by us unless specified.

3. Your privacy preferences and choices

Every personalised marketing contact sent or made by us will include a means by which customers may opt out of receiving further marketing information.
You may instruct us at any time to remove any previous consent you provided to receive marketing or survey communications from us.

4. Information sharing

We have a duty to maintain the privacy of all personal information we hold about you. However, certain exceptions do apply. For example, where disclosure of your personal information is:

  • authorised or required by law
    e.g. disclosure to various government departments and agencies such as the New Zealand Government and its agencies, or disclosure to courts under subpoena.

  • in the public interest
    e.g. where a crime, fraud or misdemeanour is committed or suspected, and disclosure against the customer’s rights to confidentiality is justified.

  • with your consent
    Your consent may be implied or express and it may also be verbal or written.

5. Updating your information

It is inevitable that some personal information which we hold will become out of date. We will take reasonable steps to ensure that the personal information which we hold remains accurate and, if you advise us of a change of details, we will amend our records accordingly.

6. Access to your personal information

We will, upon your request, and subject to applicable privacy laws, provide you with access to your personal information that is held by us. However, we ask that you identify, as clearly as possible, the type/s of information requested. We may require you to provide us with personal identification.

We will deal with your request to provide access to your personal information in a reasonable time – usually within 30 days of receipt of your request.

Exceptions

Your right to access your personal information is not absolute. In certain circumstances, the law permits us to refuse your request to provide you with access to your personal information, such as circumstances where:

  • access would pose a serious threat to the life or health of any individual;

  • access would have an unreasonable impact on the privacy of others;

  • the request is frivolous or vexatious;

  • the information relates to existing or anticipated legal proceedings;

  • the information relates to a commercially sensitive decision making process;

  • access would be unlawful; or

  • access may prejudice enforcement activities, a security function or commercial negotiations

7. Information security & storage

We are committed to keeping your trust by protecting and securing your personal information.

We employ appropriate technical, administrative and physical procedures to protect personal information from unauthorised disclosure, loss, misuse or alteration.

We limit access to personal information to individuals with a business need consistent with the reason the information was provided.

Our data including your personal information may be stored in cloud-services such as Google Workspace and Stripe who use servers in New Zealand, Australia, United States, and other parts of the world. We also use secure local (on-premises) storage. We will be compliant with applicable New Zealand data protection and privacy laws.

Although we do everything in our power to ensure a secure environment, we cannot be held responsible for a breach of our website or data security that is beyond our control.

In the event of any data breach, we will notify you within 72 hours of becoming aware of the breach.

8. Privacy Complaints

Information privacy complaints (“Privacy Complaint”) should be made to us within 30 Days of the alleged breach occurring. We prefer Privacy Complaints to be made in writing and in your own words, not with an AI writing tool. This is to minimise potential miscommunications and create a ‘paper trail’.

We are a very small company but we take the privacy of your personal information as seriously as we do our own. We will do our utmost to address any privacy complaints without bias.

However if you are not happy with our decision, you are entitled to make a complaint to the Office of the Privacy Commissioner.

Oral Complaints

Oral complaints (e.g. complaints over the telephone or in person) can be received for smaller complaints by an Owner/Director of Pansy Boys Ltd, though we may ask more complex complaints to be in writing. The Owner/Director may decide to confirm an oral outcome in writing. A transcript or notes may be made of oral complaints and/or outcomes for record keeping purposes.

Complex Complaints

If the Owner/Director believes that a complaint is complex or requires investigation, then the complainant will be invited to submit a complaint in writing. The Owner/Director or a trusted delegate will assist complainants, if requested or if it appears that the complainant requires assistance, in the drafting of the complaint.

Time Limit

We will endeavour to make a decision on all written complaints within 20 working days after the day the complaint was received. Discussion can take place with the complainant for an extension of time if circumstances suggest this is appropriate (e.g. temporary absence of staff relevant to the complaint).

Privacy Complaints Register

The Pansy Boys will establish a secured register to keep account of the status of Privacy Complaints.

9. General Conditions

We reserve the right to change this privacy policy from time to time by notice, which may be in the form of a notice posted on our website at www.pansyboys.nz

If we fail to enforce any terms or to exercise our rights under this privacy policy at any time, we have not waived those rights.

If any provision of this privacy policy is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these terms and conditions.

Unless any provision in this agreement expressly provides otherwise, this privacy policy is not intended to confer a benefit on any person or class of person who is not a party to it.

We may deliver notices to you by sending them to an email address that you have notified to us.
